Data Sharing Policy
- Policy Statement
YUI Adilitas: Journal of Justice and Legal Studies, published by YUIPublishing.id (E-ISSN: XXXX-XXXX), supports transparent, verifiable, and reproducible research in justice and legal studies. The journal requires every research article to include a Data Availability Statement explaining whether, where, and how the data and legal materials underlying its findings can be accessed. Authors are strongly encouraged to share their data openly in a trusted repository wherever ethical, legal, confidentiality, and privacy considerations allow. Sharing data is not a condition of publication, but a clear and accurate Data Availability Statement is.
- Core Principles
- Data Availability StatementEvery original research article, empirical legal study, case analysis, and review with extracted data must include a Data Availability Statement in a dedicated section placed before the References. For normative and doctrinal research, the statement should indicate where the primary legal materials used (statutes, regulations, and court decisions) can be accessed. The statement must reflect the actual availability of the data at the time of publication.
- Deposit in Trusted RepositoriesWhere possible, authors should deposit the data supporting their results, such as interview transcripts, survey datasets, coded court decision datasets, or legislative analysis matrices, in a recognized public repository that assigns a persistent identifier, such as a DOI, and cite that dataset in the article.
- Protection of Informants and PartiesData from interviewees, survey respondents, judges, legal practitioners, litigants, victims, and other human participants may only be shared in de-identified form and in line with the consent obtained for the study. Particular care must be taken with the identities of victims, children in conflict with the law, and parties in sensitive cases. Authors must comply with Law of the Republic of Indonesia No. 27 of 2022 on Personal Data Protection and with the data protection rules of the country where the data were collected.
- Restricted and Confidential DataWhen data cannot be shared publicly because of case confidentiality, closed court proceedings, advocate–client privilege, classified or restricted government documents, third-party ownership, or other legal restrictions, the statement must explain the reason and describe how qualified researchers may request access, including the responsible institution or data provider.
- Code, Instruments, and MaterialsAuthors are encouraged to make research instruments and analysis materials available, such as interview guides, questionnaires, case coding sheets, legal analysis matrices, and analysis scripts or project files (e.g., NVivo, ATLAS.ti, R, Stata, or SPSS), either as supplementary files or through a repository, so that the methods can be evaluated and reused.
- Data and Legal Source CitationDatasets and legal sources used in the study, including statutes and regulations, court decisions, and publicly available data from institutions such as the Supreme Court of the Republic of Indonesia, the Constitutional Court, the JDIH network, or Statistics Indonesia (BPS), should be cited in the reference list with the issuing body, year, title or case number, publisher or repository name, and persistent identifier or URL where available.
- Author Responsibilities
- Include a complete and truthful Data Availability Statement in the manuscript at the time of submission.
- Remove all direct and indirect identifiers of informants, respondents, litigants, victims, and participating institutions before sharing any data derived from them.
- Ensure that data sharing is consistent with the consent given by participants and with any agreement or permit obtained from courts, law enforcement agencies, government institutions, or other data providers.
- Provide the data to editors or reviewers on request during peer review, where this can be done ethically and legally.
- Keep the underlying data for at least five years after publication and make it available upon reasonable request if it is not publicly deposited.
- Inform the journal promptly if the availability of the data changes after publication.
- Example Data Availability Statements
Authors may adapt the following examples to describe their own situation accurately.
- Data openly available in a repositoryThe data that support the findings of this study are openly available in [repository name] at https://doi.org/[DOI].
- Publicly available legal materialsThis study is based on publicly available legal materials, including statutes, regulations, and court decisions, which are cited in the reference list and accessible from [e.g., the Supreme Court Decision Directory, the Constitutional Court website, or the JDIH network].
- Data available on requestThe data that support the findings of this study are available from the corresponding author upon reasonable request.
- Restricted dataThe data are not publicly available because they contain information that could compromise the privacy of informants or the confidentiality of legal proceedings. De-identified data are available from the corresponding author upon reasonable request and with permission from [name of institution].
- Third-party dataThe data were obtained from [third party, e.g., a court, law enforcement agency, or licensed legal database] and are available from [third party] with its permission. Restrictions apply to the availability of these data, which were used under permit or license for this study.
- No new dataData sharing is not applicable to this article because no new data were created or analyzed in this study.
- Recommended Repositories
Authors may use any repository that provides persistent identifiers and long-term preservation. The following general-purpose repositories are free to use and assign a DOI to each deposited dataset:
- ZenodoOpen repository operated by CERN for data, software, and other research outputs.zenodo.org
- FigshareRepository for datasets, figures, and supplementary materials in any file format.figshare.com
- Open Science Framework (OSF)Platform by the Center for Open Science for sharing data, protocols, and preregistrations.osf.io
- Harvard DataverseOpen data repository widely used for social science and socio-legal datasets from any institution.dataverse.harvard.edu
- Mendeley DataRepository for research data files with versioning and citation support.data.mendeley.com
- Repositori Ilmiah Nasional (RIN)Indonesia's national repository for research data, managed by BRIN.rin.brin.go.id
- How Data Availability Is Handled
- SubmissionAuthors include the Data Availability Statement in the manuscript and confirm it in the submission checklist (see Authors Guidelines).
- Editorial ScreeningThe editor checks that the statement is present, complete, and consistent with the research design, legal materials, and data sources.
- Peer ReviewReviewers may assess whether the available data and legal materials support the conclusions and may request access to the data through the editor.
- PublicationThe final statement is published with the article, and any linked datasets are cited in the reference list.
- After PublicationConcerns about the availability or integrity of data are handled in accordance with the journal's Publication Ethic and COPE guidance.
